Legal Question in Medical Malpractice in Tennessee

Sub-Arachnoid Haemorrhage

My baby was born with a bleed in her brain called a Sub-Arachnoid Hemorrhage, which according to a Neurosurgeon and a Neurologist probably occurred from a traumatic birth. Vacuum extraction was used when my wife and the baby's blood pressure dropped from what was believed to be too much medication pushed through the epidural. The doctors we have went to say only time will tell what damage there is to the child. The birth was 09-04-02 and my baby girl is on medications for seizure activity since 06-03, she is also deficient on her left side as a result from the bleed, and goes to physical therapy weekly. I just want to know if I may have a medical malpractice case or not, and what I need to do. Thank you.

There very well may be a malpractice claim here. As with all such cases, there has to be an in depth review of all the pertinent medical records by an expert in the areas of medicine involved before it can be determined if in fact there was negligence or malpractice. Unfortunately the statute of limitations for any claims you and your wife would have is a one-year statute. These would include any medical expenses, loss of consortium, and the like. However, your child's claim is likely still viable and not yet barred by the statute due to her minority.
