Legal Question in Personal Injury in Tennessee

Auto Accident

I was riding with a friend on 12/05/06 and a lady t-boned our vehicle, sending my head into the windshield and breaking it. I went to the ER and after having a MRI, they said I seemed ok, except for a lot of bruising. I experienced a lot of head, shoulder and neck pain, but tried to alleviate it by taking OTC pain meds...Alleve, Tylenol, etc. By Jan, 2007, I was having increased pain and the meds ceased to help. I went for chiropractic treatments, which helped, as long as I remained in treatment. When I stopped going, the pain had returned, within a week. The Insurance Company offered me $4773.70...the medical bills are $2566.85. I'm not sure what to do at this point. I do not feel this is an adequate offer, but, I don't know what a reasonable offer should be for this type of injury. Also, I'm concerned that I may have long term problems related to this accident.

No one can put an exact dollar figure on personal injury claims. There are many variables to take into consideration such as how much fault for the accident can be placed on the other driver and how much fault, if any, you had in the accident. There needs to be complete reviw of your medical records. I would be very concerned that you may have sustained a closed head injury and maybe some memory loss. Based upon your descriptions, you may have a closed head injury that only an MRI could detect. I would encourage you to have such an MRI before even considering any settlement sum for the car accident.
