We now have black mold extensively in the bathroom and 2 weks ago found around windows.I dont want to continue to live here, but dont know law since lease was signed, also cant really afford to move or hire an attorney, dont know if any legal action can be taken to sue said landlord since landlord was aware of leak and mold.Thank you for any help.

Re: Black mold in apartment

The landlord has a duty to maintain the appartment in a habitable condition. There may be question as to whether the leak and the mold cause the appartment to no be in a "habitable condition." The question sdepends on the specific facts of the case.

Also, the lease may give you certain rights if there is a breach of contract by the landlord. Look at the lease and determine what you have to do to comply with all provisions of the lease. You may have to give written notice of problems or intent to vacate.

Good luck,
