Legal Question in Personal Injury in Tennessee

Car Accident

I was involved in a car accident that was not my fault. I have suffered back pain and have been seeing my doctor. Question 1 - Should I obtain an attorney?

Also the person at fault in this accident was insured. His insurance company does not want to fix my car with new factory parts. Instead they want to use used parts. They said "if we use factory new parts your car would be totalled". Question 2 - Can I insist they use new parts?

Short answers -- GET AN ATTORNEY, and NO, you can't require that new parts be used in the repair.
