Legal Question in Personal Injury in Tennessee

Injured at my Doctors office

I went to the dr office for a back problem and while there they took blood for a routine thyroid check and after the lab nurse took the blood she turned around to do paperwork. While her back was to me i passed out and fell to the floor from the chair (which was on a step so it was higher from the floor than a chair would be). As a result i suffered a concussion, severe bruise to my forehead, broken glasses, chipped front tooth. I had neck Xrays there and then CAT scan at the hospital. I didnt fill out a accident report, and the staff was not as receptive to my injuries as i would of expected being not my fault. I have missed 2 days of work so far...should i contact a lawyer to recover lost wages and pain and suffering?

I have to disagree somewhat witm Mr. Poland.

I agree with him that the question is whether the doctor or the doctor's staff were negligent in watching you, but I would disagree on the facts you have provided in thinking there is any reason to believe there was any negligence.

Unless you told them you felt dizzy and thought you might collapse, why should they have know you were likely to pass out?

Without that knowledge, it would not seem negligent to me that they did nothing to prevent your fall.

It was good to receive your question. It certainly sounds like the doctor or his staff failed to monitor you thus contributing to your fall and subsequent injury. This could amount to negligence. If so, you would be entitled to recover for your pain and suffering, lost income, medical expenses and other types of damages. I would invite you to give me a call....Bill Poland
