Legal Question in Personal Injury in Tennessee
What am I intitled to?
I was recently involoed in a two separate accidents witin a period of a month and a half, both were the opposite parties fault. In the first accident the other party had no insurance and I tried to work out a reasonable settlement without going to court andI have still had no luck. The following accident the other party's insurance had been canceled by the company for a late payment. Still no word from them either. The 1st acc. no injuries able to still drive auto, 2nd acc. went to hospital car totaled now have to find rides for kids to school, me to school , p-t job, dr.s appt, store and etc. I only had liability due to 1st acc. could not get uninsured motorist. What am I entitled to for either accident and where can I get fair market value estimate for my car?

The first question will be is there any insurance coverage for this accident. You should get a copy of your insurance Declarations Sheet so you will know exactly what your coverage was at the time of these accidents. Many of our clients discover their insurance is different than they believed.
In general, you have a claim for property damage, medicals expenses, lost wages and pain and suffering. The value of your case depends upon the nature of your injuries and damages.

Re: What am I intitled to?
It appears as though neither of the other drivers have liability insurance coverage. Without uninsured motorist coverage on your own policy, you may be putting the cart before the horse to ask what you are entitled to. It also appears as though you are dealing with a complicated question in terms of what damage was caused to your car by the first accident versus the second accident. You may want to evaluate which of the other two drivers may be best able to pay for the damage to your car and deal with that driver in terms of property damage payment, provided, of course, that other driver is at fault for the accident.
