Legal Question in Personal Injury in Tennessee
Lawyer not doing job
I was in a car wreck over a year ago and after my settlement I am still left oweing bills and my girls money still has not been put into any kind of savings by my lawyer and he said it had to be set up that way. And now I have been hit again and have damage to my back and neck. I again am afraid that he will have me to settle and wind up paying for some of my bills on my own again when the person that hit me should be the one paying for my bills even if he does not have insurance. He does have a job. I do not feel that my lawyer is doing a good job with my case and I need to know what to do and how to get my girls money into a saving from the first car wreck. Please help.

Re: Lawyer not doing job
First, if you are represented by an attorney, you should consult with him and he should supply all the information you need to answer these questions. If you daughters are minors, it is possible that the settlement proceeds are being held by the court. Again, your attorney should be able to give you an accounting of the settlement proceeds and what medical expenses were paid by insurance and/or out of the settlement.
Having been involved in hundreds of injury claims, I know that the process can seem lengthy and confussing to clients. It may be that your lawyer is doing his job, you just don't know or understand what action he has taken on your behalf. Communication is the key.
It is your claim and you get to make final decissions about whether or not to settle. An attorney can give you advice and tell you what they think is in your best interests. However, the claim is yours.
I encourage you to consult with your attorney and see if communication clears up the situation.
Best of luck,
