Legal Question in Personal Injury in Tennessee

Lawyer lied to me!

Help!Dismissed current lawyer for making false statements about my case.He said it was up to his discretion whether he sent in certain medical records to the insurance company concerning a personal injury case.He sent in all the medical records and when I asked him about this he said ''If I dont send in all the medical records I will get into trouble.''Then he pressured me to settle for very little compensation for my back and neck injuries,I was never given a breakdown of the costs,fees,medical bills,etc in writing.After telling me if I did not take what their final offer was the insurance company was going to rescind their offer and I would not get anything.I was under pressure and told him verbally over the phone to settle,but did not sign any forms or the check.I called his office and told him to send the check back because I felt like I was being coerced into taking such a small sum.After dismissing him he sends me a letter stating he has put a lien on the check for over 9,000 dollars.After the medical bills are payed,this leaves me with 938.00 dollars.Also,he has refused to give me back my file.What are my legal rights?Also where do I stand legally with the insurance company?

I am not sure what you beleive your lawyer lied to you about. He is ethically bound to turn over medical expenses. If you dismissed him he has the right to put a lien on the proceeds if allowed by contrat and law (probably so). You can challenge amount of lien in Court or through Board of Professional Responsibility. With all of these issues, you need to speak with a new attorney - if you never signed anything, the case is not settled and the issue can be revisited with the insurance company though they will be displeased to find out that you have breached the settlement agreement - a Judge can force you complete the transaction unless you were under fraur or duress.
