What is the time limit to file a personal injury claim after the accident.

Generally, the answer to your question is 1 year. However there are some important exceptions. For example, if the injured party was a minor, if the negligence was not discovered right away, or if the injured party was mentally incompetent at the time of the accident, the statute of limitations can be different. It is even possible for the deadline to be shorter than one year as in cases involving slander.

Accordingly, as with most legal questions, a lawyer needs to know all the facts before he or she can give a definitive answer.

In Tennessee, the statute of limitations for personal injuries from an accident is generally one year.

The normal statute of limitations for personal injury claims in Tennessee is one year from the date of the accident. However, the one year time limitation begins running on the date of the accident so that the one year lapses on the day before the one year anniversary of the accident.
