Legal Question in Personal Injury in Tennessee

Multi-Car Wreck

I was involved in a 4 car crash in tennessee I was the only

Driver not at fault. I was the first car felt all 3 hits.

I need to know if one insurance company will settle or do I

have to settle with each one individually. I did get hurt and lost wages due to this . One of the insurance companys

have related to me that each company will pay 33.3% of the

settlement but each one will have there own release sighned and determine there own settlement by Tennessee Law.

Is this true . I'm from Oklahoma and my Insurance Company

cannot give me the answer to this question

Each insurance company will only settle, or more specifically pay out on a claim, in the percentage of negligence their insured bears for the collision. Therefore, you will have to deal with all three of them. They will each want their own release signed and they will each send their own separate check.

If you were not at fault, and from the facts you related it appears you weren't, the other three drivers will be responsible to you based upon the degree of the fault assigned to each one up to possibly the limits of their individual insurance policies. There is not a set formula to determine the percentage of fault for each driver. There is a one year statute of limitations for personal injuries in Tennessee.
