Legal Question in Personal Injury in Tennessee

My wife and I were involved in a car accident that was cuased by another person. This isn't in dispute. We were both taken from the scene in a ambulance as the crash was extensive involving the car being totaled. The airbags cuased both of us to have chest pain for a month along with other minor pain. My wife missed a weeks worth of work and has been left with some scarring from the seatbelt and a lump from blood build-up from extensive bruising. I want to approach the insurance company with a settlement offer however I have nothing to base what a reasonable amount would be.

The value of a personal injury case is very subjective and dependent on a large range of variables. You must evaluate the nature and extent of the injuries involved and compare them with the amount of medical expenses and time lost from work. You should also consider whether there is any comparative fault on your part. Even though you and the other driver may conclude she was "at fault" legally a jury can determine how much, if any, of the accident was your fault and reduce your recovery accordingly.

You should have your case evaluated by an attorney. Unfortuately, insurance companies usually will not pay the amount they should in settlements unless an attorney is involved.

You need to make sure that the chest pains are not due to any internal injuries. An x-ray, MRI or Cat Scan should determine whether you have only bruising or something more serious. Compensatory damages in Tennessee generally include medical bills, pain and suffering, lost wages, loss of earning capacity and loss of consortium, if any. Loss of consortium is a term used to describe the loss of spousal companionship due to your injuries. Property damages would include damage to your car and any personal belongings in the car.
