Legal Question in Personal Injury in Tennessee
settled against own will now my knee is hurting
I had a car accident in 2003. In the accident i broke my kneecap and was out of work for about five months. I didn't have any income coming in for five months and m bills were piling high. My doctor told my lawyer that i more than likely would not suffer any long term damage. The lawyer said that it would best to settle. I agreed because the lawyer said i would have great chace of losing. The next day i called and told him i changed my mind after researching cases simular to mine. The lawyer said that it was to late. I tried to talk to other lawyers to see if he could do this but they would not talk to e because i already had a lawyer. Now my knee is starting to hurt and i was wondering if there was anything else that i could do. I settled for 25,000 but after all of the fees i got about 14,000. Could please let me know if there is any other avenue that i can take. Any help or suggestions would be greatly appreciated.

You may have a cause of action against your lawyer for attorney malpractice. But there is a one-year statute of limitations on malpractice claims. If you settled before August 2004, you probably can't sue your former lawyer.
