Legal Question in Personal Injury in Tennessee

Slip and Fall Premises Injury

I was at a local, major car dealership having my car serviced. When I walked through the customer service center to retrieve my car, I slipped and feel in puddle of water that was in the customer service center landing on the concrete floor. There was no wet floor sign and I was walking normal. I notified the proper people at the dealership and the service tech witnessed the fall as did others. I have a letter stating the dealership's insurance will pay the medical bills. I already have a claim number with their insurance. I went to my doctor and was diagnosed with a contusion (axillary nerve damage) to my left shoulder. At this time it is not believed that I will need surgery perhaps physical therapy. I am unable to go to work until I am out of the sling which probably will be another week. Do I have a claim for medical, pain and suffering, and lost wages?

Re: Slip and Fall Premises Injury

If properly documented, your claim would be for your medical expenses, lost wages, expenses, pain and suffering, and other potential damages. It sounds as if your medical treatment is not complete at this time, and further treatment will have a direct impact on the value of your claim. The dealership, or its insurance carrier, will be likely motivated to reach a settlement with you as soon as possible in order to minimize the amount they would have to pay you for your injury. You should not sign anything they present you until you have consulted with a competent personal injury attorney. The value of your claim will depend upon a number of factors which an attorney can discuss with you. Our firm's offices are in Franklin and we will be glad to consult with you at no cost to you.
