Statute of Limitation
I was injured on the job and am receiving workers compensation for the injury. The cause of the injury was a faulty product I was installing. When I am released from the doctor and the workers compensation is settled, is there a statute of limitation on the time to file suit against the manufacturer of the product being installed? I have been unable to work for seven months.

You have one year to file suit from the date of your accident. I would like to discuss your case with you and if it would be helpful, I will come to your house to discuss your claim.

This is a complex question. Generally there is a one year statute of limitations that that begins to run on the date of injury. There is also a "Statute of Repose" on products. I need to know when the product was manufactured to answer your precise question.......You need to discuss this in detail with your worker's compensation attorney, if you have one. If you do not have one, you really need an attorney to guide you as the worker's compensation insurance carrier could file the products liability case in order to recover the payments they make to you and this could be against your best interests. If you have been off work for seven months, it appears that you have a very serious injury and you need advice on how to get all the worker's compensation benefits to which you are entitled.
