Being sued over coverage limits
My wife was at fault in an injury accident, and the victim has filed suit over our policy limits. My wife and I do not have significant assets (besides our home which is under mortgage), and my wife��s income is fairly low because she is a full time college student. The victim has been offered the policy limits of 50K, but wants 150K. Also, I will add that my wife was in a rental car. Questions:
�X Do you really think they will pursue us over the limits of the insurance?
�X I know they can come after joint assets, but can they come after my income?
�X Am I liable if my wife divorces me?

Are you not being represented by your insuror's attorney? these are questions that should be directed to him/her, but I'll answer what I can:
Do you really think they will pursue us over the limits of the insurance? I highly doubt it. That's very rare and only done if there are substantials assets to attach. In your case, it's sounds like your wife doesn't have any. The plaintiff's demand for over the policy limits is mostly a bluff and scare tactic to intimidate you.
�X I know they can come after joint assets, but can they come after my income? If you were not made a party to the lawsuit then "NO". If you were made a party defendant to the lawsuit, then "YES".
�X Am I liable if my wife divorces me? Again, if you were not made a party to the lawsuit then "NO".
