Legal Question in Personal Injury in Tennessee
verbal agreement concerning property
I allowed my friend, per her request, to take my horse to her barn for 5 to 7 years while my daughter was away at college, instead of turning him out to pasture. Her offer was to house, feed and care for all vet fees in exchange for the pridledge of riding him and to use him to help train her other horses. 7 years is up, we moved him back to our barn. A month later she filed a civil suit against me wanting me to return her personal property claiming after one year it was considered abandonment and she was now the legal owner. She wants me to return him and sign over his papers to her. He is a registered Egyption Arabian with a freeze brand registered to me. He was sired by a 80,000.00 horse but had poor confirmation and bad knees was sold to by 13 yr old daughter for $800.00 because the women that owned him liked my daughter. He was kind of a gift. Should I worry about this suit? And what can I do? Also, he was neglected. His weight is at a low 5 on a scale of 1 to 10. His hooves will take a good year to get back in shape with possible tendon damage from 1 1/2 splits on his hooves. I had to have his teeth floated by a ''Vet-Dentist, $154.00, because he couldnt eat. Something that should have been done at least 1x per year.

Re: verbal agreement concerning property
You should certainly be concerned about the nature of the suit - it becomes a he/she said situation unless you have independent witnesses who knew what the terms of the deal were. Would be glad to talk to you about this - would hate for your family to lose a member.
