Legal Question in Real Estate Law in Tennessee
Divorce and remove name financially
I am getting a divorce and my husband has agreed to quick-claim both houses to me, as well as doesn't not want to be financially responsible. I'm not sure how to remove his name off the mortgages without having to refinance them. Does the mortgage company have to remove his name by law once the divorce has been finalized? If not, what other suggestions do you have? Thanks

Re: Divorce and remove name financially
The mortgage company is NOT obligated to remove your husband's name or liability on the loans. Refinancing is the only way to remove his liability. Your divorce lawyer should be able to give you advice on these issues.
