Legal Question in Real Estate Law in Tennessee
MY greatgrandfather gave power of attorney to my aunt. He is a vetran of WWII. He just found out that his house payment is $4500.00 past due and if he doesn't come up with the money VERY soon he will loose his home. Can her power of attorney be revoked and how can this be accomplished and he retain his home? Please advise soon.
1 Answer from Attorneys
Yes, his power of attorney may be revoked, if he is competent to execute a revocation. If he is competent, he may revoke the power of attorney in writing, and should reference the attorney-in-fact (your aunt) by name, as well as the date on which the original power of attorney was executed.
Regarding your great-grandfather's ability to keep his house, this issue may or may not be able to be addressed by revoking the power of attorney. A response to this question would require additional information.
