Legal Question in Real Estate Law in Tennessee
land annexing
several years ago my dad bought property at the end of a dead end road. he then procedded to build a house several hundred yards off the end of that county road , then built and connected his drive way to the end of it. now the county is sayin it is a county road...can they legally do this? turn his personal property into county right of way without even asking?

Re: land annexing
Your dad should check the deed and the county map to make sure that the land he put his driveway on wasn't already the county's. If it wasn't, then he has a case for inverse condemnation. That's where the government takes your land without paying for it. If you are in the Middle Tennessee area, please have your dad call my office to discuss the matter. Thanks,
