Legal Question in Real Estate Law in Tennessee
My name is Natalie Kazsuk and my husband and I own a rental home where we hired one of our friends to be our property manager. Through many different things that have happened, we feel that he is abusing his priviledges. My question is this: If we do not have a written property management agreement between himself and I- can we terminate this business relationship without any negative legal ramifications? Also, if we do not have a property management agreement and we decide to fire him- can he lash back at the tenant since they do have a written lease for a year and it has his company as the lessor? I do not wish to disturb the tenants, but have a feeling he might cause problems and tell them that they are in violation of their lease. Would they be obligated to move out into a different property managed by him or could we just change the lease over to us as the lessor?

If you have no contract with the property manager, then based upon the information you share, I don't know of any legal obligation you have to continue the relationship. As the property owners, you can elect to resume direct management of the property at any time.
Regarding the current tenants and their lease, without reviewing the document, I can't say whether or not there would be an issue if the property manager attempted to interfere with their occupancy of the property.
