Legal Question in Real Estate Law in Tennessee
Purchasing land with property line issues
I am looking at a lot for home construction in an existing subsdivision. The dimensions of the lot did not check out after a ''rough'' measurement. After the owner had the property surveyed by a licensed professional, it was found that the neighbor's driveway is over the line. The first 5 or 6 feet of the concrete driveway beyond the street right of way is about 10'' over the property line. How should this be handled before purchasing or is this an issue at all? Thanks.

Re: Purchasing land with property line issues
This is an issue. That neighbor could get an easement or title to that part of your property through prescription. The driveway needs to be moved or you should contract for the neighbor to purchase that area of the yard.
