If a piece of propery is jointly owned but one of the owners lives on it and pay taxes, can this person mentioned contest the split of the property and will a judge let him take ownership because he has paid the taxes and lives on it?

Either party can certainly contest the other party's contentions. A judge can take all the circumstances into consideration. Consult with a local attorney.
