Withholding Sexual Harassment Information

Sexual harassment has definately occured, but the victim has not yet filed a complaint. If that person confides in another co-worker and seeks help from that person, is it illegal for them to NOT notify the employer or EEOC?

It is not illegal to not tell an employer about the sexual harassment, but it may be a violation of company policy. By contrast, if a witness is asked by the EEOC as part of its investigation of a sexual harassment claim if the harassment occurred and the individual lies about it, that could present a case of perjury.
