creating a confusing will
My Mother-In-Law has asked me to make out her will. Her husband died in Jan. She ownes two homes. She has 5 adult children. One of the daughters lives in the family home with her. She also wants to will the other house to this same daughter to do with as she pleases. It is currently rental property. However, she wants the main family home to go to all the children with the daughter that presently lives there to be able if she chooses to remain in the home with the contents. The family home and it's belongings would belong to all five siblings, equal shares. The daughter that presently lives there would be resonsible for the up-keep of the property. She wouldn't be required to pay rent to the other 4 owners during the time she lived there. The same would apply if any of the other 4 decided to stay at the home. The house could only be sold if all five agreed and only if the sister that currently lives there has moved. What kind of will is this and what type of clause is this? Will it cause problems later? Is she setting the path for a legal mess by tring to maintain the family home? If my husband and I pay for and send her to a lawyer, how expensive will this be?

A simple will costs about $75.00. It will be worth that many times over rather than trying to draft something with as many contingencies in it as you propose....The very last thing you want is a confusing will that has to be probated and go through court....Bill Poland
