Legal Question in Wills and Trusts in Tennessee

Becoming executor after the person passes

My cousin passed away in tennessee. Her possessions are in an apartment and they won't let me in. There is nothing else she has but 5,000 dollars in the bank. She has no other family members. She owes lots of bills. The told me in order to get into the apartment i would have to become executor of estate. If no becomes one her things will be put on the road. I ask the lawyer who represents the apartment complex is there money owed. He said there could be. He could not tell me that information. I do not know if i should become executor of her. All she had was just furniture and dishes. Costumn jewelry and clothes. I know she owes alot of medical bills and credit card bills. If i become executor will i be responsible for those bills.

Re: Becoming executor after the person passes

You do not personally become liable for the bills unless you agree to pay them. If you are sure that there is not enough assets to pay all her bills then it does not seem that there is any purpose in becoming executor. There may be a county guardian or conservator you could talk to first.
