Legal Question in Wills and Trusts in Tennessee
My mother is 80 years old, retired in TN, no debt (currently), and has no property or assets other than her social security and a savings account. She has no will and wants to compose a holographic will. She plans on being cremated and is putting money into a "Payable Upon Death" account at her bank. She doesn't want to deal with probate court and really doesn't even want to do the holographic will. Does she need one since she has the POD account?

A holographic will is a will written completely in the handwriting of the testator (the person making the will). If you mom has no real estate, no motor vehicles and her only asset is this one checking account you should be good to get it set up as a payable on death account. There would be no reason to open a probate estate based upon the information you've provided.
