Legal Question in Wills and Trusts in Tennessee

Obtaining a copy of medical records

I am trying to get a copy of my great grandfather's medical records.

He has been deceased since 1943 and there are no other known

relatives living other than my mom, aunt, and uncles. I wrote to the

institution where he was being treated up to his date of death and

the director of the medical department said I needed someting

authorizing a representative of the decendents estate. Until then,

the records will remain confidential. Where do I obtain that

authorization or how do I become the authorized representative of

his estate?

Re: Obtaining a copy of medical records

If your grandfather died in 1943 and no estate was ever opened for him, an estate would need to be opened in the county of his legal residence at the time of death. Once an Administrator of the estate is appointed, the Administrator would be authorized to obtain the medical records. The estate is opened by petitioning the probate court.

The closest surviving relative (your Mom, your aunts or your uncles) would be the petititioner.
