What rights do grown children have to Dad's belongings?

My dad committed suicide, as far as we know he didn't have a will. His wife, our step-mother, will not allow us to have anything of his; we aren't even allowed to go to his house. The land is in both their names, the home is in his name alone, he has several bank accounts and an IRA. No estate has been set up in his name in Probate court. Everybody knows, including step-mother, that dad promised certain things to my brother when he died and we all want him to have those things but step-mother says we are not getting anything of his; but step-mother has allowed her grown son from a previous marriage take things from the home that belong to my dad. We are all grown with families of our own but it would be nice to have something that belonged to dad. Do we have any rights? If so, what steps should we take?
