Legal Question in Wills and Trusts in Tennessee

Sister left no will

My sister passed without a will. She has 2 children from a previous marriage. The house is deeded to her and the land is also deeded to her. What rights does her husband have to this property in the state of Tennessee. Do the children need representation to claim their shares? What steps do they need to take? He is asking them to divide her personal property with his daughter (their step-sister) what claims does she (the step-sister) have?

The property was inherited from sister's parents and the initial money for building the house was from money from a life ins. policy from her deceased son; but the husband did probably use his money for some of the building of the house with proceeds from the sale of his former house.

Please help us unravel this.

A proceeding to probate the estate can be filed by the spouse or an heir. If the spouse hasn't filed a petition asking the court to probate the estate and appoint him administrator soon, I'd have one fo the heirs file. I can help. 423 266-4855
