Legal Question in Workers Comp in Tennessee

Effect on prior injury

I was in a car wreck 10-98 while on the job. It Peeled the top of my head back, broken collar bone, triple fracture of tibia/fibula of rightleg with IM nail and screws, lower back injury. I have a injury from 16 years ago leaving my left leg 1 1/4" short and my ankle and foot have limited range. I am in physical therapy now for the right leg but my left leg is becoming increasingly sore and swollen from having to carry most of the load. The insurance company will

not allow the Doctor or Physical therapy to treat the left leg. In as much as the injury to the right leg is causing further injury to the left leg and slowing my overall recovery shouldn't they at least offer physical therapy? Thanks.

down my overall recovery

Re: Effect on prior injury

They certainly should be liable for any medical problems caused by your on-the-job injury, whether direct or indirect, regardless of whether the affected site had sustained previous injury or not. The task is to provide medical proof of the causal connection, which may not be easy if your treating physician is a typical "company doctor" who won't make a committment on such an issue for fear of alienating his referral source.
