Workmen's Compensation Insurance

My brother is incarcerated. He was hurt at work. Workers Comp is changing insurance. And his girl friend has been cashing his checks. He gave her permission to cash a few. But that all. He thought his worker's comp was cut off. But she is still cashing they & not giving him any.(1) He wants to know if it will effect him any. (2) What can he do to she or about her cashing his checks.

Your brother needs to himself or hire a lawyer to write the insurance company a letter telling them not to send the girlfriend any more checks and where they should be sent. He may need to fill our a particular form in order to legally notify the insurance company. He will need to talk with a lawyer in the state where the workers compensation award was entered to determine if incarceration will affect the right to compensation.

endorsing and/or cashing someone's check without their permission is a felony. The worker's compensation carrier should be contacted and told to redirect the checks to someone who has permission to cash them or they should hold the payments until your brother is out of jail. By telling the carrier he is incarcerated could affect the value of your brother's claim.
