Can i bring her back home?

Three months ago my daughter went to live with her husband and enrolled in a new school. Several issues have come up to make me realize this is not in her best interest. No legal pleadings have been filed by her father as far as change of conservator. He's $12,000.00 in arrears for child support. Do I have the right to go to her father's house, tell her to get her things, and bring her back home to live?

I have to agree with John Pfister,jr and James Grissom that you should not waste any time i think you should take him to court and get a devoice and power over daugher and if you think hes not a good father well do something fast and I really recomand Mr.Jhon,and Mr james you call one of them they are very good laywers to help you i other hand don't understand what you posted upbut i will get in contact with john and james about whats going on and if you got any more qurestions just feel free to email me at [email protected]

If your "daughter" is living with her "husband", she is an emancipated minor and you have no further say what is in her best interest. If the father's $12,000 in arrears has been reduced to judgment, you might be able to take steps to collect it. If no judgment, it's lost.

After reading your question I am uncertain if your daughter is currently living with her husband or her father. If she is living with her husband you cannot force her to come back to your house. If she is living with her father you can bring back to your house by enforcing the divorce decree. One question I have is how old is your daughter? I will presume that she is not living with "her" husband but your ex-husband. Otherwise, you are out of luck.

If no court action, then you can go get her and have her come home with you. I suggest you take steps to bring her back before your ex takes steps to change the order. If he lives in a different county than issued the original divorce decree, then after six months he can have the case transfered to his county, forcing you to fight there. As for the arrears, don't waste too much time bringing a motion to enforce and reduce the arrearage to a judgment. If you have any further questions, give me a call.
