Legal Question in Wills and Trusts in Texas

probate a will

My dad died and left everything to my mother.

He had a very simple will stating this.

Does his will have to be probated?

If so,how much should this cost and what type of a lawyer do we have to get to do this?

We don't want my mom to have to spent alot of money on this.

Unless your father had real estate (a home) and/or substantial assets, it probably won't be necessary to probate the will. In Texas the probate process is simple and relatively inexpensive. As an example, for a simple probate I charge $1,500 plus filing fees (appx. $200) and the entire process is usually concluded within 3-4 months.

It is going to depend upon the composition of your Dad's Estate. Is any property located out of Texas? These question and the answers can take in the initial interview with they attorney. Most attorneys don't charge for an initial interview.
