2255 Hearing
The hearing was granted. Inmate was in transport back to Odessa. There has been 2 postponements on this hearing so far. Officers involved have also postponed depositions again due to lack of counsel for the second time.
When does the 120 days start?

I'm not sure what you mean by "120 days." I am not surprised that there have been delays in the hearing. 2255s often move rather slowly. Does the inmate have a lawyer? Usually, even if the inmate cannot afford a lawyer, the court will appoint once a hearing has been set. The inmate should move to have counsel appointed if he/she cannot afford one. If the inmate can afford a lawyer, and he/she has not hired on yet, that needs to be done ASAP!
