Can attorney keep court fees?

We found an attorney in the phone book that states, "No legal fees down on Chapter 13". We spoke to him once, and he said he only required the $160 court filing fee down. We signed the paper stating we were hiring him to file Chapter 13 and would pay him $2000 through the plan and $160 for court costs. We paid $160 that day. They could not make up a bankruptcy plan we could afford so we decided not to file. (He never went to court for us.)They will not return the $160 court fees. They say if we sue, they will sue us for the full $2000. Should we sue the attorney?

I suggest contacting the bar association to see if they have

a fee dispute mediation service. This may well get you the

relief you need, but be less expensive and less confrontational.
