Legal Question in Bankruptcy in Texas

Bankruptcy and Apartment Rental

How might a bankruptcy effect my ability to rent an apartment? I have rented once before, in another state, and had no problem paying the rent or utilities. Currently, I am staying with a friend, but I want to move out, very soon.

Re: Bankruptcy and Apartment Rental

Short answer -- I think your ability to rent an apartment will depend on the individual apartment's leasing office.

After you have filed bankruptcy all of your debts will be "discharged" (the term in bankruptcy for eliminate or wipe-out) Since you would not have any more debts some apartments might look at this as a good situation because the rent would be one of the only bills you had to pay. On the other hand, many apartments don't like to rent to people who have filed bankruptcy. You may have to get a cosigner or maybe deposit a few months of rent in advance. If you can verify employment for several months it would be likely you could get an apartment somewhere. Since so many people have had to file bankruptcy, apartment companies will probably have to change their policies. If you reside in the Houston area I would be pleased to handle your case.
