Legal Question in Bankruptcy in Texas
Bankruptcy and debts assigned in divorce
If debt is assigned in a divorce to one spouse and that person files for bankruptcy does that release the other spouse from the liability and keep their credit rating? If you file bankruptcy can it keep you from going into certain types of career fields? (i.e., title business, escrow officer)

Re: Bankruptcy and debts assigned in divorce
Although a divorce court may assign the obligation for a debt to one party, the creditor will still look to all parties liable on the debt for repayment. Therefore if one former spouse files and the other is liable on the debt it will only be discharged as to the spouse filing. There is no legal reason that filing a Bankruptcy would prevent you from obtaining a job as you described. You are within your legal rights to file, it is not a question of dishonestly etc. Of course a potential employer could factor this into their evaluation. You can call to discuss if you wish.
