bankruptcy during discrimination law suit
help: I've been involved in a discrimination suit for over a year and have won the right to sue from state. I'm also filing bankruptcy this month. Can i lose any funds i may be awarded if i file chap 7 or 11? I was diagnosed with Hep C and Cirrhossis last summer, the company terminated me after i shared the info with them, can't work while on interferon for a year - having to file bankruptcy don't know what else i can do. Also just approved for disability with Social Security. thanks so much.

You would probably file either a Chap 7 or Chap 13. chap 11 is the reorganization provision of the Bankruptcy Code. If you file Chpa 7 and elect the federal exemptions, you lawsuit proceeds may be exempt under Sec. 522(c)(11)(E) of the Bankruptcy Code, exempting payments in compensation of loss of future earnings.
