Legal Question in Bankruptcy in Texas

My husband's medical insurance filed bankruptcy in 2001. This has left us with $35,000.00 of unpaid medical bills. In the process trying to pay these, my health is not good,

plus the current ones, has left us in a struggle. I do not see how we can pay all of these as my husband is 64 and would like to retire in 2-2005. Would filing bankruptcy help us or not. My husband uses all of his paychecks trying to pay doctors, hospitals, due to PGA Management's bankruptcy. We have collectors for doctors, hospitals, calling constantly. I am 60 and would work, but have had a failed back surgery, with Dr. doing a neurospine stimulator 6-22-04. PGA dropped all these bills on us in November of 2001. My husband said we would still have to pay, plus loosing all of our credit history.

I just need an answer to our conflict. If we did not have to pay all the 2001 medical bills that was the responsiblity of PGA, we could make our current bills ok. As it is, we cannot put any more money up for our retirement. What can we do?

You should definitely file for bankruptcy in my opinion. You will not have to pay the medical bills if you file. You will only be responsible for your current medical bills as they become due. Your credit will be effected but at your age credit is really not a major issue. PLEASE READ MY FIRM PHILOSOPHY. Everyone deserves a chance to get relief and start over fresh!
