Legal Question in Bankruptcy in Texas
Bankruptcy for married couples
My husband and I were married approx. 2 years ago. He brought with him a lot of debt that he and his live in girlfriend incurred during there years together. I have good credit, but his ''sucks'' to be blunt. Can he file bankruptcy on his own without using me or my credit?

Yes. You are not liable for his debts incurred before marriage, nor are you liable for contractual debts, such as credit card debts, incurred solely by your spouse.

Your husband can file an individual filing and you would not be effected. However, if he filed a chapter 13 case, your income might be a factor that is considered in his case. I would be happy to speak with you personally about the specifics of your situation. Please call (214) 979-7330
