Legal Question in Bankruptcy in Texas

Bankruptcy as related to child support.

I have custody of my 2 children and my wife is court

ordered to pay child support. She is in arrears approximately $7,000.00.

In September, 2003, she and her present husband filed bankruptcy in Harris County, Texas. How does the bankruptcy effect her paying child support? I have contacted the Texas Attorney General regarding her nonpayment of child support but they tell me that if she fails to make child support payments then she no longer is protected by the bankruptcy, however, they also don't seem to know or cannot advise me regarding next procedure. If she continues to not make her child support payments which she never has paid, does this dissolve the bankruptcy? What can I do? How long can she hide behind the bankruptcy?

Contact a local bankruptcy lawyer. Child support debts are not dischargeable in bankruptcy.
