Legal Question in Bankruptcy in Texas
Brankruptcy and the Separated Woman
I live in Texas and have been separated from my husband for almost 4 years. The debt I have was incurred during the marriage but is all in 'my' name. I would like to know if I can file for bankruptcy even though I am still legally married. My husband is an attorney himself and says I can't do this... but that's another story and legal question.

Any one can file for bankruptcy whether they are married or not. In addition, if someone is married they do not have to file jointly they can file a single bankruptcy. If you have a debt and are unable to pay it then discuss this with an attorney in your area about getting this debt discharged. If you can not afford an attorney check with your local state or county bar or legal aid and see if they can help you. GOOD LUCK
