Legal Question in Bankruptcy in Texas
I am in chapter 13, my attorney conspiring with opponent council against me what deciplany trule and ethical rule is violated?
1 Answer from Attorneys
The best thing to do is first address the situation with your attorney to determine what the facts are. In chapter 13 you are dealing more with the trustee and creditors so the likelihood of collusion is lower than in some other areas of the law.
There are many rules that deal with this situation, however if you feel your attorney is not acting in your best interest or that there may be a conflict of interest then you can end the representation and retain another attorney. If you feel the acts are extremely egregious then you can check with your states bar counsel and determine what can be done. The best thing again is to determine the facts and address it with your attorney first or confer with another attorney to determine if things are being done correctly.
