Legal Question in Bankruptcy in Texas

Chapter 13 filed and about to default

I filed Chapter 13 in March, I couldn't stick to the plan, varios reasons. I have to be in Court in Beaumont on Sept.25, they want to default my plan. Will I lose everything, which is basically nothing but my 96 Jeep. Can I change and file Chapter 7? My debt total is 20-23000. I am 24 years old, divorced, with 2 children, and obviously financially struggling, any advise?

Re: Chapter 13 filed and about to default

Probably the best person to ask is your Chap 13 lawyer as he/she has all your facts. You may convert to a Chap 7 plan or you may let the court dismiss the Chap 13 and then file a Chap 7. Your Jeep is exempt. However if it is financed you have to make the payments on it to keep it. -Larry Maun 713-266-2560
