Legal Question in Bankruptcy in Texas
Chapter 7 and IRS taxes
We have a tax return for the 1996 tax year that was filed on time with no extensions. The IRS reviewed, not audited, the return and noticed that some income was reported to them, but no W-2's were ever sent to us. We now have a tax debt of nearly $4,000. We are preparing to file a Chapter 7 in the next ouple of weeks and are preparing our creditors list.
1. Should we list the IRS as a creditor?
2. Can this debt be discharged?
