Legal Question in Bankruptcy in Texas
chapter 7
On July 10, 1997 I had to file for Chapter 7. I may be in the unfortunate position that I may have to file for an other Chapter 7.
Can an other Chapter 7 be filed by me or an attorney on my behalf, or has not enough time gone by???
I had submited this question in the past, but the response was erased by mistake.

You may seek relief under Chapter 7 if the previous discharge was granted under a filing commenced six years ago or longer. Please let me know if you'd like me to help.

The key date is the date of the discharge. 6 years needs to have passed. Keep in mind the Bankruptcy Trustee frowns on repeat applications and you will need a good reason why you should be granted relief again.

I have a strategy that we use in situations like this. If you have only filed for bankruptcy once before than you could file another case by filing chapter 7 or (if there is an emergency) by filing chapter 13. However, you can only file a chapter 7 case 6 years after the first case was discharged. Please feel free to call me to discuss your situation in more detail.
