Legal Question in Bankruptcy in Texas
Chapter 7 or Chapter 13
I have recently filed a Chapter 7 pro se bankruptcy. I just spoke to someone today from bankruptcy attorney's office and they said that since some of my debt is from payday loans, that yes my loans would most likely be discharged, but they could come back and file criminal charges against me for ''writing bad checks''. The fact is, I was not aware that I was even going to file upon my last ''roll-over'', I just could not see any other alternative. I was struggling to pay my mortgage and my cars with this ''trap''. Is this true? Or am I better off converting my Chapter 7 to a 13 to save my property and possibility of criminal charges later.

I don't think this is likely after a discharge, especially from a predatory lender. Before making any decisions I would check with the local District Attorney's office.
