Legal Question in Bankruptcy in Texas

Creditor Question

I was discharged from a bankruptcy file in 1992 in Ar. in 1996 . Since then I have had 1 creditor that did not remove my debt from their records. Instead they sold the account to another bank as a good account. I keep getting collection notices from different banks and collection agencies everytime this account is sold. I explain that this debt. was included in my bankruptcy and I never hear from them again till they sell the account to another unsuspecting bank. And then the process starts all over again. This debt is not listed on any of the 3 major credit report companies, so it doesn't affect my credit, but I am so tired of getting bills about this debt. What can I do to stop them from selling this debt agasin to another company.

Thanks in Advance!!!!!!!!!!!!

Re: Creditor Question

A fellow attorney and myself have been concentrating on this unique area of the law. There are not many bankruptcy attorneys who are well versed in this area. It is definitely a problem that often goes unchecked. Creditors have been getting away with garbage tactics like this for a long time. Likely, the best approach will be to re-open your bankruptcy case and "sue" the creditors for their actions. Please feel free to contact me to discuss your situation in more detail.
