Legal Question in Bankruptcy in Texas
Divorce in California with Texas Bankruptcy
I filed bankruptcy in Texas with my spouse in 1998. In 2001, i filed divorce in California. Divorce is final as of June 5, 2003. I did a stupid thing, i said my ex can pay all the bankruptcy and no child support till bankruptcy is paid off. I changed my mind. I want him to pay child support now. He says that if I do that I will have to pay have of the bankruptcy. Is this true? What can I do? I have no job and wouldn't be able to pay anything on the bankruptcy.

A bankruptcy agreement between spouses cannot forgive child support without a modification in the family court. Your liability with respect to the bankruptcy and child support will be spelled out in the documents. If you are being needlessly pressured, you do have legal recourse.
