Legal Question in Bankruptcy in Texas
ex-spouse filing bankruptcy
my ex-husband is considering filing bankruptcy for about $10,000 in joint credit cards. we have been divorced approximately two years. we did a do-it-yourself divorce, and the credit card debts were not allocated to either of us. we were paying $280 per month on the debts thru CCCS. since then, we have been unable to make the payments on the debts, hence his decision to file bankruptcy. in the nearly two years we have been divorced, i have remarried and bought a home/vehicle with my current husband. i would like to know what effect, if any, his filing of bankruptcy will have on me and my current husband and our assets.

We have met the enemy and he is us! Do-it-yourself divorces are shunned even by lawyers whoare seeking divorce because the do-it-yourselferstend to forget something important.
Anyway, if your ex- files for a bankruptcy discharge, his obligation on the credit cards will be erased but yours won't - you, alone, will be liable to make the payments. There should be no adverse effect on your credit rating, as long as you make the payments.
